A shocking revelation has come to light, leaving many questioning the safety practices of a popular retailer. City Beach, a well-known fashion brand, has been ordered to pay a hefty $14 million in penalties for supplying non-compliant button battery products. But here's where it gets controversial...
Between June 2022 and October 2024, City Beach admitted to supplying over 54,000 products that failed to meet the button battery safety standard, and over 56,000 products that did not comply with the button battery information standard. These products, including toys, digital notepads, keyrings, and even accessories for Crocs shoes, were often marketed towards children.
The Federal Court observed that City Beach had shown a lack of responsibility and urgency in understanding and adhering to its obligations under the Australian Consumer Law. Their actions put over 50,000 young children at risk of severe injury or even death, a fact that the Court described as "condemnable."
"Today's penalty serves as a stark reminder that businesses must prioritize safety, especially when it comes to products that can cause serious harm," said ACCC Commissioner Luke Woodward. "Button batteries are not something to be taken lightly. They can be fatal, and we will not tolerate any negligence in this regard."
This case marks the first court proceeding brought by the ACCC for breaches of the button battery safety standards. Earlier this month, the Court found City Beach in violation of the Australian Consumer Law for selling non-compliant consumer novelty products.
The Court has ordered City Beach to implement a comprehensive consumer law compliance program and to actively advertise their voluntary recall of the affected products. Additionally, an injunction has been issued, restraining City Beach from future contraventions of the Mandatory Standards.
After a contested hearing on penalties, the Court has now ordered City Beach to pay a total of $14 million. This serves as a strong message to all businesses that safety standards are non-negotiable.
